The Hell Of Applying For Government Benefits
The Atlantic has a piece written by Laura Kwerel on The Hell of Applying for Government Benefits. Here’s an excerpt: It’s 11:30 a.m., and after three hours of waiting, I have finally gotten to the front of the line at the Social Security Administration on M Street in Washington, D.C. I have come to see if they received a fax—the agency rarely uses email to communicate with the public. [Read More...]
Crespo v. Colvin: SSDI Appeals
Crespo v. Colvin, a case from the United States Court of Appeals for the Seventh Circuit, involved a claimant who applied for Supplemental Security Income for his mother. Supplemental Security Income (SSI) is a program administered by the United States Social Security Administration (SSA). SSI is designed for disabled children of low-income families and blind or disabled adults. This program is different from the Social Security Disability Income (SSDI) program that is designed for people who have worked long enough to earn quarterly credits to qualify for disability benefits. As our Boston disability attorneys can explain, when another a person (usually a family member, but it can be a court appointed guardian) applies on a disabled claimant’s behalf, this is known as representative payee situation under … [Read More...]
Musculoskeletal Injuries: How Severely Impaired Must I Be?
Intentionally or not, the Social Security Administration has done a good job selling the idea that winning disability benefits is extremely hard. Bloggers (including me) write about the long delays and the arbitrary nature of decisions and the possibility of drawing a judge who would not approve a deathbed claimant. Clearly, claimants without compelling medical evidence are having an increasingly difficult time winning. Ten years ago, judges were much more likely to accept your testimony about your work activity limitations – now, judges are looking for extensive medical evidence. I often hear from, or end up representing disability claimants who have been denied at the administrative (initial application or reconsideration) and who are about ready to give up. Ironically, many of these claimants have cases that are… [Read More...]

Psychological Illness and Social Security Disability Insurance Benefits
While most people think of physical disabilities in the context of Social Security Disability benefits, a sizable number are incapacitated as a result of psychological illness. According to a recent news report from Medical News, the Institute of Medicine is calling for use of standardized psychological testing protocols for claimants applying for Social Security Disability Insurance benefits. It has been suggested these standardized methods will improve accuracy of claim determinations relating to mental health issues. However, those who favor this approach tend to believe it would save the United States Social Security Administration money, because it would reduce the number of people receiving Social Security disability benefits for reasons of mental illness. This, of course, assumes there are many people who claim to have severe mental health … [Read More...]
